Tavo Jones had worked since 1974 for Westshore Resorts, where he maintained golf carts. During the first decade, he received positive job evaluations and numerous merit pay raises. He was promoted to the position of supervisor of golf-cart maintenance at three courses. Then a new employee, Ben Olery, was placed in charge of the golf courses.

Olery demoted Jones, who was over the age of 40, to running only one of the three cart facilities, and he froze Jones’s salary indefinitely. Olery also demoted five other men over the age of 40. Another cart facility was placed under the supervision of Blake Blair.

Later, the cart facilities for the three courses were again consolidated, but Blair not Jones was put in charge. At the time, Jones was still in his 40s and Blair was in his 20s. Jones overheard Blair say, We are going to have to do away with these old and senile men. Jones quit, and he sued Westshore for employment discrimination. Thoroughly discuss whether he should prevail, and cite to case law to support your response.
